Except as noted below, Equipment sold by Desiccant Rotors International, Inc. ("DRI") is warranted by to be free from defects in workmanship or materials for a period of eighteen (18) months from the date of shipment to the original Customer or twelve (12) months from date of equipment startup, whichever occurs first. This Warranty does not apply to damage or failure caused by misuse, improper maintenance or contamination of the wheel components; damage or failure caused by other component malfunction or operation of the equipment under conditions beyond those specified by DRI or; equipment altered or repaired after shipment by any person not authorized by DRI.

DRI shall in no event be liable for any alterations or repairs made without its written consent.

Customer must install and maintain the equipment according to written instructions in the installation, operation and maintenance (IOM) documents. If, for some reason, IOM documents are not included with any shipment, please notify DRI at once.

This Warranty applies ONLY to parts/items that are defective when shipped from our facility. If a part is found to be defective when shipped, whether this defect shows up immediately or, during the Warranty period, through proper use of the Equipment, we will repair the part, furnish a replacement part or issue a credit memorandum, at our option. Customer shall notify DRI of any defects in a timely manner.

This Warranty does not cover the supply of consumable items such as lubricating oil & grease, seals, V belts, etc., and does not cover the cost of routine maintenance of the Equipment.

This Warranty does not cover excessive seal leakage in applications where the Equipment is subjected to differential pressures between air flows greater than 7" WG, or when Equipment is installed in air handlers with fans in blow-through supply/draw-through exhaust configuration. It is the sole responsibility of Customer to inform DRI of the pressures the Equipment will be subjected to at the time of Equipment selection, so that seal leakage levels may be determined and fans sized accordingly.

This Warranty does not cover Equipment that has been not been applied in accordance with current ASHRAE (American Society of Heating, Refrigeration and Air Conditioning Engineers) guidelines, including, but not limited to, use in applications utilizing fume hood exhaust systems.

In cases where Equipment sold by DRI may be subject to the terms and conditions of another's manufacturer's warranty, DRI shall make such warranty available to the Customer to the extent permitted by the terms and conditions of such warranty. DRI makes no warranty of any nature whatsoever to Customer with respect to such Equipment.

The effects of corrosion, erosion, excessive heat & cold, dirt, dust, foreign materials, and normal wear and tear are specifically excluded from this Warranty.

THIS WARRANTY DOES NOT INCLUDE LABOR. The customer is responsible for labor, including the costs associated with the removal and reinstallation necessary to accomplish the repair or replacement of defective components. This Warranty does not include delivery of materials to the job site or rigging, scaffolding, lifts or labor necessary to install replacement equipment or parts. Buyer is responsible for lifting requirements, cranes, unpacking, etc., as well as removal of previously supplied or installed materials.

THE OBLIGATIONS EXPRESSED IN THIS WARRANTY ARE IN LIEU OF ALL OTHER OBLIGATIONS AND LIABILITIES, INCLUDING ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR PARTICULAR APPLICATIONS OR PURPOSES, WHICH ARE HEREBY EXPRESSLY EXCLUDED. NEITHER DRI NOR ITS REPRESENTATIVES SHALL BE LIABLE TO CUSTOMER, OR ANYONE ELSE, FOR ANY LIABILITY, CLAIM, LOSS, DAMAGE OR EXPENSE OF ANY KIND, OR FOR ANY DIRECT, COLLATERAL, INCIDENTAL CONSEQUENTIAL, OR EXEMPLARY DAMAGES RELATIVE TO, ARISING FROM, CAUSED DIRECTLY OR INDIRECTLY BY THE EQUIPMENT, ITS INSTALLATION OR THE USE THEREOF OR ANY DEFICIENCY, DEFECT OR INADEQUACY OF THE EQUIPMENT AND IT IS EXPRESSLY AGREED THAT THE CUSTOMER'S EXCLUSIVE REMEDY FOR ANY CAUSE OF ACTION RELATING TO THE PURCHASE, INSTALLATION AND/OR USE OF THE EQUIPMENT SHALL BE FOR DAMAGES AND DRI'S LIABILITY FOR ANY AND ALL LOSES OR DAMAGES RESULTING FROM ANY CAUSE WHATSOEVER , INCLUDING WITHOUT LIMITATION NEGLIGENCE, STRICT LIABILITY, ANY OTHER TORT, BREACH OF CONTRACT AND BREACH OF WARRANTY SHALL IN NO EVENT EXCEED THE PURCHASE PRICE OF THE EQUIPMENT IN RESPECT TO WHICH THE CLAIM IS MADE, OR AT THE ELECTION OF DRI THE RESTORATION, REPLACEMENT OR REPAIR OF SUCH EQUIPMENT.

At the time of placement of order by Buyer to DRI, the Buyer indicates his assent to the above as the sole & exclusive Warranty Agreement between DRI and Buyer.
